This Release and Waiver of Liability (the “Release”) is executed on by the Volunteer in favor of Manos de Cristo, a Texas non-profit corporation, and its directors, officers, employees, and agents (collectively, “Manos de Cristo”). The Volunteer desires to work as a volunteer for Manos de Cristo. The Volunteer, on behalf of himself or herself and his or her agents, executors, administrators and assigns (all of whom are included in the use of term “Volunteer” below) does hereby freely, voluntarily, and without duress execute this Release under the following terms:
Waiver and Release. Volunteer does hereby release and forever discharge and hold harmless Manos de Cristo and its successors and assigns from any and all liability, causes of action, claims and demands of whatever kind or nature, either in law or in equity, including without limitation attorneys’ fees and court costs (collectively, “Claims”), which arise or may hereafter arise from Volunteer's work for Manos de Cristo. Volunteer understands and acknowledges that this Release discharges Manos de Cristo from any Claims that the Volunteer may have against Manos de Cristo with respect to any bodily injury, personal injury, illness, death or property damage that may result from Volunteer's work for Manos de Cristo, whether caused by the negligence of Manos de Cristo or its officers, directors, employees, agents, volunteers, or otherwise. Volunteer also understands that, except as otherwise agreed to by Manos de Cristo in writing, Manos de Cristo does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance, in the event of injury or illness.
Criminal History Information. Volunteer hereby gives permission for Manos de Cristo to obtain information relating to his/her criminal history record. The criminal record, as received from the reporting agencies, may include arrest and conviction data as well as plea bargains and deferred adjudication. Volunteer understands that this information will be used, in part, to determine my eligibility for a volunteer position with this organization, and also understands that as long as Volunteer remains a volunteer here, the criminal history records check may be repeated at any time. Volunteer understands that he or she will have an opportunity to review the criminal history and a procedure is available for clarification, if he or she disputes the record as received. Volunteer hereby release and forever discharge and agree to defend, hold harmless and indemnify Manos de Cristo from and against any and all Claims resulting from the investigation of my background in connection with my application to become a volunteer.
Insurance. The Volunteer understands that, except as otherwise agreed to by Manos de Cristo in writing; Manos de Cristo does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.
Medical Treatment. Except as otherwise agreed to by Manos de Cristo in writing, Volunteer does hereby release and forever discharge and hold harmless Manos de Cristo and its successors and assigns from any and all liability or claims which arise or may hereafter arise on account of any first aid, treatment, or service rendered in connection with Volunteer's work for Manos de Cristo.
Photo, Audio and Video Release. Volunteer does hereby grant and convey unto Manos de Cristo all rights, title, and interest in any and all photographic images and video or audio recordings made by Manos de Cristo during the Volunteer's work for Manos de Cristo, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Severability. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as is permitted by the laws of the State of Texas, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. Volunteer agrees that in the event that any clause or provision of this release shall be held to be unenforceable, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this release, and such clause or provision shall be enforced to the maximum extent permitted under Texas law.
